Terms and Conditions of Use — MariachiYA

1. ACCEPTANCE OF THE TERMS

By accessing and using the MariachiYA mobile application ("the Application", "we", "us", "our"), you ("the User", "you") agree to be legally bound by these Terms and Conditions of Use ("Terms"). If you do not agree to these Terms, you must not use the Application.

Standard EULA: Use of this Application is also subject to the Apple Standard Licensed Application End User License Agreement (EULA), which supplements these terms.

2. DESCRIPTION OF THE SERVICE

MariachiYA is a platform that connects users seeking mariachi services with providers of such services. The Application facilitates:

• Search and discovery of mariachis and musical groups.
• Booking of mariachi services for events.
• Communication between users and providers.
• Review and rating system.
• Management of payments and subscriptions.

3. REGISTRATION AND USER ACCOUNT

To use certain functions, you must be at least 18 years old or the age of majority in your jurisdiction. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.

4. ACCEPTABLE USE

You agree to use the service legally and legitimately, providing truthful information and respecting the rights of other users. Activities such as harassment, impersonation, or attempting to interfere with the Application's operation are strictly prohibited.

5. RESERVATIONS AND SERVICES

MariachiYA acts as an intermediary platform. Providers are responsible for confirming or rejecting reservations. Any modifications to a confirmed reservation must be agreed upon by both parties through the Application.

6. PAYMENTS AND SUBSCRIPTIONS (Guideline 3.1.2)

6.1 Auto-Renewable Subscriptions

MariachiYA offers subscription plans for Providers to access premium features:

• Monthly Plan: Renewable every month.
• Annual Plan: Renewable every year.

6.2 Subscription Terms

• Payment: Payment will be charged to your Apple ID account at the confirmation of purchase.
• Auto-Renewal: The subscription automatically renews unless it is canceled at least 24 hours before the end of the current period.
• Renewal Charge: The account will be charged for renewal within 24 hours prior to the end of the current period.
• Management: You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase.
• Price: The specific price for your region will be clearly displayed in the Application before you confirm the purchase.

6.3 Refunds

Refunds for subscriptions and in-app purchases are managed by Apple. You must request a refund directly through the App Store.

7. REVIEWS AND RATINGS

Users may rate services after completion. Reviews must be honest, respectful, and based on real experiences. We reserve the right to remove content that violates our policies.

8. COMMUNICATION AND MESSAGING

The Application includes a chat system for users and providers. This system must be used professionally and only for matters related to the requested services.

9. LOCATION AND GEOLOCATION

The Application uses your location to show nearby providers and improve search results. You may revoke location permissions at any time through your device settings.

10. INTELLECTUAL PROPERTY

MariachiYA and all related logos are trademarks. You may not copy, modify, or distribute the Application's source code or content without express written permission.

11. PRIVACY POLICY

12. LIMITATION OF LIABILITY

MariachiYA is a connection platform and is NOT an employer of the providers. We are not responsible for the quality of services provided by third parties, nor for disputes between users. The Application is provided "AS IS".

13. TERMINATION

We may suspend or terminate your account immediately if you violate these Terms or engage in fraudulent activities.

14. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of Ecuador.

• You have the legal capacity to accept these Terms.
• You understand that MariachiYA is solely a connection platform.

By clicking "I Accept the Terms and Conditions" or by using the Application, you confirm that you have read, understood, and accepted these Terms in their entirety.
